Welcome to Volunteeritude! These Terms of Service ("Terms") constitute a legally binding agreement between you and Volunteeritude ("we," "our," or "us") governing your use of our website, mobile application, and related services (collectively, the "Services"). By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

1. Eligibility and Account Registration

1.1 Eligibility Requirements

To use Volunteeritude, you must:

  • Be at least 13 years old
  • Be located in the United States
  • If you are between 13 and 18, you must have parental or guardian consent to use the Services
  • Have the legal capacity to enter into a binding agreement

Important: Volunteeritude is currently available only to users in the United States. By using the Services, you represent and warrant that you are accessing them from within the United States.

1.2 Account Types

Volunteeritude offers two types of accounts:

  • Volunteer Accounts: For individuals tracking volunteer hours and connecting with organizations
  • Organization Accounts: For nonprofit organizations and educational institutions managing volunteer programs

1.3 Registration Requirements

When you register for an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Not create an account using false information or impersonate another person or entity
  • Not create multiple accounts for fraudulent purposes
  • Accept the Beta Agreement (as the platform is in beta testing)

2. Account Security and Responsibilities

  • You are solely responsible for maintaining the confidentiality of your account credentials (username and password)
  • You must use a strong, unique password and not share it with anyone
  • You are responsible for all activities that occur under your account, whether or not authorized by you
  • You agree to immediately notify us at admin@volunteeritude.com if you suspect any unauthorized access to or use of your account
  • We are not liable for any loss or damage arising from your failure to protect your account credentials
  • You may not transfer, sell, or assign your account to another person without our prior written consent

3. Services Description

3.1 Volunteer Features

For volunteers, our Services include:

  • Volunteer hour tracking and service log management
  • Organization connections and membership management
  • Event registration and attendance tracking
  • Volunteer goals and progress tracking
  • Awards and recognition
  • Profile customization and skill/interest tagging
  • Dashboard analytics and reports

3.2 Organization Features

For organizations, our Services include:

  • Volunteer hour verification and management
  • Event creation and registration management
  • Custom field collection for volunteer data
  • Volunteer roster and directory
  • Service log bulk upload and CSV imports
  • Reports and analytics dashboards
  • Organization profile pages
  • Invitation and request management
  • Administrator role management
  • Premium features (available through subscription)

3.3 Beta Status

Volunteeritude is currently in beta testing. Features may change, be added, or be removed without prior notice. We are not responsible for any data loss, service interruptions, or bugs that may occur during the beta period. By using the Services, you agree to provide feedback and report issues to help us improve the platform.

4. User Content and Conduct

4.1 Your Content

"User Content" means any information, data, text, photos, videos, files, or other materials that you submit, upload, post, or otherwise make available through the Services, including but not limited to:

  • Service logs (volunteer hours, activities, reflections)
  • Profile information (bio, photos, skills)
  • Event descriptions and materials
  • Comments, messages, and feedback
  • Custom field responses

4.2 Ownership

You retain all ownership rights to your User Content. However, by submitting User Content through the Services, you grant Volunteeritude and its service providers a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with providing and improving the Services.

4.3 Content Responsibilities

You represent and warrant that:

  • You own or have the necessary rights to submit your User Content
  • Your User Content does not violate any third-party rights (including intellectual property, privacy, or publicity rights)
  • Your User Content is accurate and truthful (especially service logs and volunteer hours)
  • Your User Content complies with these Terms and applicable laws

4.4 Content Standards

You agree that your User Content will not:

  • Be false, misleading, or fraudulent
  • Contain hate speech, harassment, threats, or incite violence
  • Be obscene, pornographic, or sexually explicit
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Contain malware, viruses, or other harmful code
  • Be spam or unsolicited advertising

4.5 Service Log Accuracy

CRITICAL: You agree to provide accurate and truthful information when logging volunteer hours. Falsifying volunteer hours or service logs is a material breach of these Terms and may result in immediate account termination. Organizations rely on the accuracy of this data for reporting, recognition, and verification purposes.

5. Prohibited Activities

When using the Services, you agree NOT to:

  • Violate any applicable local, state, national, or international law or regulation
  • Use the Services for any fraudulent, deceptive, or unauthorized purpose
  • Interfere with, disrupt, or create an undue burden on the Services or networks connected to the Services
  • Attempt to gain unauthorized access to any portion of the Services, other accounts, or connected systems
  • Use any automated means (bots, scrapers, crawlers) to access the Services without our express written permission
  • Impersonate another person, organization, or entity
  • Collect, harvest, or store personal data about other users without their explicit consent
  • Upload or transmit viruses, malware, or other malicious code
  • Engage in any activity that could damage, disable, overburden, or impair the Services
  • Reverse engineer, decompile, or disassemble any portion of the Services
  • Use the Services to harass, abuse, stalk, threaten, or intimidate others
  • Create derivative works based on the Services without authorization
  • Remove or alter any copyright, trademark, or other proprietary notices

6. Organization-Specific Terms

6.1 Organization Verification

Organizations must provide accurate information about their nonprofit or institutional status. We reserve the right to request documentation (e.g., 501(c)(3) determination letter, EIN verification) to verify organizational status.

6.2 Volunteer Data Responsibilities

Organizations agree to:

  • Use volunteer data only for legitimate volunteer management purposes
  • Comply with all applicable privacy laws (FERPA, COPPA, CCPA, etc.)
  • Obtain necessary consents before collecting sensitive information from volunteers
  • Protect volunteer data with appropriate security measures
  • Not sell, rent, or trade volunteer data
  • Respect volunteers' privacy settings and data sharing preferences

6.3 Verification Responsibilities

When verifying volunteer service logs, organizations must review submissions carefully and verify hours accurately. Falsely verifying hours or rejecting legitimate submissions without cause may result in account suspension.

6.4 Educational Institution Compliance

Educational institutions using Volunteeritude for student volunteer tracking agree to comply with FERPA and other applicable educational privacy laws. Institutions are responsible for obtaining parental consent for students under 18 where required and ensuring all data handling complies with district policies and state regulations.

7. Payment Terms (Organization Subscriptions)

7.1 Billing

Certain organization features require a paid subscription. Payment processing is handled by Stripe, our third-party payment processor. By subscribing, you agree to Stripe's terms and conditions.

7.2 Subscription Terms

  • Subscriptions automatically renew at the end of each billing period unless canceled
  • You authorize us to charge your payment method for all fees incurred
  • Prices are subject to change with 30 days' notice
  • You are responsible for all taxes associated with your subscription

7.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings or by contacting support
  • Cancellations take effect at the end of the current billing period
  • Refunds are generally not provided for partial months or unused subscription periods
  • We may offer refunds at our sole discretion on a case-by-case basis

7.4 Free Tier and Beta Access

During the beta period, certain premium features may be available at no cost. We reserve the right to modify, limit, or discontinue free access to premium features at any time with reasonable notice.

8. Intellectual Property Rights

8.1 Our Rights

The Services, including all software, designs, text, graphics, logos, icons, images, audio, video, and other materials (excluding User Content), are owned by Volunteeritude and protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, or distribute any of our intellectual property without our express written permission.

8.2 Trademarks

"Volunteeritude" and associated logos are trademarks of Volunteeritude. You may not use our trademarks without prior written consent.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant us an unrestricted, perpetual, irrevocable right to use, modify, and incorporate such feedback without any obligation to you.

9. Third-Party Services and Links

The Services may integrate with or contain links to third-party services, including:

  • Payment processors (Stripe)
  • OAuth providers (Google)
  • Email services (Postmark)
  • Analytics services
  • Organization websites and social media

We are not responsible for the content, privacy practices, or terms of service of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

10. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data collection, use, and sharing practices.

11. Disclaimers and Limitations of Liability

11.1 "AS IS" Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

11.2 Volunteer Activity Disclaimer

VOLUNTEERITUDE IS A VOLUNTEER HOUR TRACKING AND MANAGEMENT PLATFORM. WE DO NOT ORGANIZE, SUPERVISE, OR ASSUME LIABILITY FOR ACTUAL VOLUNTEER ACTIVITIES. YOU PARTICIPATE IN VOLUNTEER ACTIVITIES AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY INJURIES, DAMAGES, OR LOSSES ARISING FROM YOUR VOLUNTEER WORK.

11.3 Data Accuracy

While we strive to maintain accurate data, we do not guarantee the accuracy, completeness, or reliability of any User Content, including service logs, event information, or organization profiles. Users are responsible for verifying information independently.

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOLUNTEERITUDE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Volunteeritude, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your User Content
  • Your interactions with other users or participation in volunteer activities

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at admin@volunteeritude.com or through your account settings. Upon termination, your account will be deactivated and your data will be deleted in accordance with our Privacy Policy and data retention policies.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false information
  • Inactivity for an extended period
  • Requests by law enforcement or government agencies
  • Technical or security concerns

13.3 Effect of Termination

Upon termination, all rights granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination (including ownership provisions, warranty disclaimers, indemnification, and limitations of liability) shall survive.

14. Modifications to the Services and Terms

14.1 Changes to Services

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

14.2 Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by:

  • Posting the updated Terms on this page with a new "Effective Date"
  • Sending an email notification to your registered email address
  • Displaying a prominent notice within the Services

Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services and may delete your account.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Volunteeritude is incorporated, without regard to conflict of law principles.

15.2 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at admin@volunteeritude.com to attempt to resolve the dispute informally. We will work in good faith to resolve the matter within 30 days.

15.3 Arbitration

Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English in [Location]. Judgment on the arbitration award may be entered in any court having jurisdiction.

15.4 Class Action Waiver

YOU AND VOLUNTEERITUDE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Volunteeritude regarding the Services and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

16.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, or internet/network failures.
